一九八七年一月十九日国务院批准 第一章 总 则 第一条 根据《中华人民共和国统计法》（以下简称《统计法》）的规定，制定本实施细则。 第二条 《统计法》所指的统计，是国民经济和社会发展情况的统计。其主要内容包括：人口和劳动力统计；国民财富统计；农、林、牧、渔、水利业统计；工业统计；地质普查和勘探业统计；建>业统计；交通运输、邮电通讯业统计；商业、公共饮食业、物资供销和仓储业统计；房地产管理、公用事业、居民业务和咨询业务业统计；卫生、体育和社会福利事业统计；教育、文化艺术和广播电影电视事业统计；科学研究和综合技术业务事业统计；金融、保险业统计；财政和财务统计；物价统计；国民经济综合平衡统计；固定资产投资统计；人民生活统计；政治、法律和民政统计等。 第三条 国家机关、社会团体、企业事业组织和城乡各种个体经营户以及各种联合经济组织，在中国境内的外资、中外合资和中外合作经营的企业事业组织，港澳和台湾同胞、华侨在中国境内举办的独资、合资或合作经营的企业事业组织，我国在港澳地区及国外举办的独资、合资或者合作经营的企业事业组织，都必须依照统计法和本实施细则规定，提供统计资料，不得虚报、瞒报、拒报、迟报，不得伪造、篡改。基层群众性自治组织和公民，有义务如实提供国家统计调查所需要的情况。 第四条 国家有计划地用现代信息技术装备各级人民政府统计机构，建立健全国家统计信息自动化系统。国务院各主管部门根据工作需要，有计划地用现代信息技术装备本部门及其管辖系统的统计机构。 第五条 各级统计机构和统计人员必须建立统计工作制，建立考核制度和奖惩制度，不断提高工作质量和工作效率。同时，依法独立行使以下职权：一、统计调查权——调查、搜集有关资料，召开有关调查会议，检查与统计资料有关的各种原始记录和凭证。被调查单位、人员必须提供真实资料和情况，不得拒报、虚报和瞒报；二、统计报告权——将统计调查所得资料和情况加以整理、分析，向上级领导机关和有关部门提出统计报告。任何单位、个人不得阻挠和扣压统计报告，不得篡改统计资料；三、统计监督权——根据统计调查和统计分析，对国民经济和社会发展情况进行统计监督，检查国家>策和计划的实施，考核经济效益、社会效益和工作成绩，检查和揭露存在的问题，检查虚报、瞒报统计资料的行为，提出改进工作的建议。有关部门对统计机构、统计人员反映、揭露的问题和提出的建议应当及时处理，作出答复。 第六条 地方各级人民政府、各主管部门、各企业事业组织，应当根据国家统计任务和本地方、本部门、本单位的需要，加强对统计工作的领导和监督：一、领导和支持统计机构、统计人员和其他有关人员执行统计法规和统计制度，准确、及时地完成统计工作任务，加强统计工作现代化建设；二、吸收和组织统计人员参与讨论有关>策和计划、研究经济和社会发展问题的会议，发挥统计的业务和监督作用；三、根据国家统一部署，组织实施重大的国情国力普查；四、按照规定审批统计调查计划，切实解决经批准的统计调查所需的人员和经费。 第七条 国家统计局和县级以上地方人民政府统计机构是国家贯彻并监督执行统计法规的机关，负责检查统计法规的实施，维护统计机构和统计人员的合法职权，同违反统计法规的行为作斗争。 第二章 统计调查计划和统计制度 第八条 县级以上人民政府统计机构和主管部门按以下三类情况分别建立统计制度，制订统计调查计划，按规定经审查机关批准后贯彻实施。一、国家统计调查，是指全国性基本情况的统计调查，包括由国家统计局单独拟订的和由国家统计局与国务院有关部门共同拟订的调查项目。国家统计调查计划中，新的、重大的调查项目，由国家统计局报国务院审批；经常性的、一般性的调查项目，国务院授权国家统计局审批。各地方、各部门、各单位必须严格按照国家统计调查方案实施。国家一般每十年进行一次重大国情国力（人口、工业、农业、建>业、业务行业等）普查。在两次普查中间进行一次人口状况的简易普查。二、部门统计调查，是指各部门的专业性统计调查。部门统计调查计划及其调查方案，由主管部门的统计机构组织本部门各有关职能机构拟订统计，其中调查对象属于本部门管辖系统内的，由本部门领导人审批，报国家统计局或者同级地方人民政府统计机构备案；调查对象属于本部门管辖系统外的，报国家统计局或者同级地方人民政府统计机构审批，其中重要的，报国务院或者同级地方人民政府审批。各部门统计调查管辖系统的划分办法，由国家统计局商同国务院各主管部门提出，报国务院批准实施。三、地方统计调查，是指地方人民政府所需要的地方性的统计调查。地方统计调查计划及其调查方案的报批办法由省、自治区、直辖市人民政府统计局规定，报国家统计局备案。 第九条 部门统计调查和地方统计调查不得与国家统计调查相重复、矛盾。国家统计调查与部门统计调查、地方统计调查的分工，由国家统计局同国务院各主管部门和省、自治区、直辖市人民政府统计局具体商定。 第十条 各级人民政府的综合协调部门所需的统计资料，一般应当从同级人民政府统计机构和主管部门搜集；如果确实需要直接进行统计调查时，应当作出统计调查计划和调查方案，依照《统计法》和本实施细则规定，经审批后实施。 第十一条 统计调查计划按统计调查项目编制。统计调查项目，是指某一时期为某一调查目的而组织的一项统计调查。每一调查项目的计划必须列明：项目名称、调查机关、调查目的、调查范围、调查对象、调查方式、调查时间、调查的主要内容。制定统计调查计划，必须同时制定每个统计调查项目的调查方案。统计调查方案包括：一、供调查对象填报用的统计调查表及说明书；二、供整理上报用的统计综合表及说明书；三、统计调查所需人员和经费及其来源。 第十二条 各级人民政府统计机构、各主管部门统计机构对送审的统计调查计划及其调查方案的必要性、可行性、科学性进行严格审查，不符合本实施细则规定的，应当退回修改或者不予批准。在制订和审查统计调查方案时，应当贯彻以下原则：一、在已经批准实施的各种统计调查中能搜集到资料的，不得重复调查；二、抽样调查、重点调查、典型调查或者行政登记可满足需要的，不得制发全面统计调查表；一次性调查即可满足需要的，不得进行经常性统计；按年统计即可满足需要的，不得按季统计；按季统计即可满足需要的，不得按月统计；月以下的进度统计必须从严控制；三、颁发新的统计调查方案，必须先行试点或者征求有关地方、部门和基层单位的意见，进行可行性论证，保证切实可行，注重调查效益；四、统计调查所需的人员和经费应当有保证。 第十三条 按规定程序批准的统计调查方案，必须在调查表的右上角标明制表机关名称、表号、批准或者备案机关名称及其批准文号。被调查的单位、人员，应当准确、及时、无偿地按调查方案填报。未标明上述字样的统计调查表（包括以搜集统计数字为主的调查提纲）是非法报表，任何单位或者个人有权拒绝填报，各级人民政府统计机构有权废止。 第十四条 统计调查方案所规定的指标涵义、调查范围、计算方法、分类目录、调查表式、统计编码等，未经制定该统计调查方案的机关同意，任何单位和个人，不得修改。 第三章 统计资料的管理和公布 第十五条 各地方、各部门、各单位应当健全统计资料的审核制度，保障统计资料的准确性和及时性。各部门、各企业事业组织提供的统计资料，由本部门、本单位领导人或者统计负责人审核、签署或者盖章后上报。有关财务统计资料由财务会计机构或者会计人员负责提供，并经财务会计负责人审核盖章。各级人民政府统计机构和乡、镇统计员提供的统计资料，由人民政府统计机构负责人或者乡、镇统计员审核、签署或者盖章后上报。各地方、各部门、各单位的领导人对统计机构和统计人员依照《统计法》和统计制度提供的统计资料不得修改；如果认为统计资料不实，应当责成统计机构、统计人员和有关人员核实订正。统计机构、统计人员提供的统计资料如果上报期限已到，可先行上报并加说明，核实后确有错误，应当在上级规定的期限内订正。 第十六条 各级领导机关制定>策、计划，检查>策、计划执行情况，考核经济效益、社会效益和工作成绩，进行奖励和惩罚等如需要使用统计资料时，必须依照《统计法》第十二条规定，以各该统计机构或者统计负责人签署或盖章的统计资料为准。 第十七条 各级人民政府统计机构必须做好统计信息咨询业务工作，充分利用可以公开的社会经济信息为社会公众业务。符合国家有关规定，在《统计法》和统计制度规定之外提供的统计信息咨询，实行有偿业务，具体办法由国家统计局会同国家物价局制定。 第十八条 各地方、各部门、各单位必须贯彻执行国家统计局制定的《统计资料保密管理办法》，加强统计资料的统一管理。 第十九条 各地方、各部门、各单位必须建立统计资料档案制度，按照国家档案局有关规定妥善保管、调用和移交。 第四章 统计机构和统计人员 第二十条 国家统计局的职责是：一、依照国家法律、>策和计划，制定统计工作的规章，制订统计工作现代化规划和国家统计调查计划，组织领导和协调全国统计工作，检查监督统计法规的实施；二、健全国民经济核算制度和统计指标体系，制定全国统一的基本统计报表制度；制定或者与有关部门共同制定国家统计标准，审定部门统计标准；三、在国务院统一领导下，会同有关部门组织重视的国情国力普查，组织协调全国城市和农村社会经济抽样调查；四、根据国家决定>策、制定计划、进行管理的需要，搜集、整理、提供全国性的基本统计资料，并对国民经济和社会发展情况进行统计分析、统计预测和统计监督；五、审查国务院各部门的统计调查计划及其调查方案，管理国务院各部门颁发的统计调查表；六、检查、审定、管理、公布、出版全国性的基本统计资料，定期发布全国国民经济和社会发展的统计公报；七、统一领导和管理全国城市和农村社会经济抽样调查队；八、组织指导全国统计科学研究、统计教育、统计干部培训和统计书刊出版工作；九、开展统计工作和统计科学的国际交流。 第二十一条 县级（含县和市辖区）以上的地方各级人民政府统计机构的职责是：一、完成国家统计调查任务，执行国家统计标准，贯彻全国统一的基本统计报表制度；二、制订本地区的统计工作现代化规划和地方统计调查计划及其调查方案，统一领导和协调本地区内包括中央和地方单位的统计工作，检查监督统计法规的实施；三、根据本地区决定>策、制定计划、进行管理的需要，搜集、整理、提供基本统计资料，并对本地区国民经济和社会发展的基本情况进行统计分析、统计预测和统计监督；四、审查本地区各部门的统计调查计划及其调查方案，管理本地区各部门制发的统计调查表；五、按照规定，检查、审定、管理、公布、出版本地区的基本统计资料，省、自治区、直辖市人民政府统计局定期发布本地区国民经济和社会发展的统计公报；市、县人民政府统计机构，按同级人民政府决定，发表统计公报；六、统一管理本地区城市和农村社会经济抽样调查队；七、组织指导本地区各部门、各单位加强统计基础工作建设；加强统计教育、统计干部培训以及统计科学研究工作，对本地区人民政府统计机构干部和乡、镇统计员进行考核与奖励。地方各级人民政府统计机构受同级人民政府和上级人民政府统计机构的双重领导，在统计业务上以上级人民政府统计机构的领导为主。 第二十二条 乡、镇统计员执行乡、镇综合统计的职能，其职责是：一、完成国家统计调查和地方统计调查任务，执行国家统计标准，贯彻全国统一的基本统计报表制度，贯彻并检查监督统计法规的实施；二、按照规定，搜集、整理、分析、提供和管理本乡、镇的基本统计资料；三、组织指导本乡、镇各有关部门、人员加强农村统计基础工作建设，健全本乡、镇的统计台账制度和统计档案制度，组织乡、镇以下的统计业务工作。各省、自治区、直辖市或者市、县人民政府根据《统计法》的规定以及统计工作的需要设置乡、镇统计员，建立健全乡、镇统计信息络。乡、镇统计员和乡、镇统计信息络在统计业务上受县人民政府统计机构领导。乡、镇以下的行政村的统计工作，由村民委员会指定专人负责，他们在统计业务上受乡、镇统计员领导。 第二十三条 各级人民政府主管部门的统计机构或统计负责人执行本部门综合统计的职能，其职责是：一、组织指导、综合协调本部门各职能机构（包括生产、供销、基建、劳动人事、财务会计等机构）的统计工作，并共同完成国家统计调查、部门统计调查和地方统计调查任务，贯彻并检查监督统计法规的实施；二、制订本部门的统计工作现代化规划和本部门统计调查计划及其调查方案，组织指导本部门及其管辖系统内企业事业组织的统计工作。加强统计队伍和统计基础工作建设；三、按照规定，向上级领导机关和同级人民政府统计机构报送和提供本部门的基本统计资料，会同计划和其它有关职能机构对本部门执行政策、计划的情况，经营管理的效益，进行统计分析、统计预测和统计监督；四、管理本部门制发的统计调查表和基本统计资料；五、会同本部门的人事教育机构，组织指导本部门的统计教育、统计干部培训；进行本部门统计人员的考核与奖励；加强本部门统计科学研究工作。各级人民政府主管部门统计机构的设置，应根据实际需要，本着精简、效能的原则，按照《统计法》的规定执行。 第二十四条 各级人民政府统计机构和各主管部门根据工作任务的需要，可以在不突破编制的原则下设置统计检查机构或者统计检查员。统计检查机构和统计检查员的职责是：一、定期深入检查统计法规和统计制度的实施情况，揭发、检举或者处理违反统计法规的行为；二、对违反统计法规的人员或单位，提出处罚意见，构成犯罪的，由司法机关追究刑事；三、对符合本实施细则第三十条规定的人员或者集体，提出表扬和奖励的建议。统计检查机构和统计检查员在规定的职责范围内行使统计检查权力。统计检查员由各级人民政府统计机构或者各主管部门委任，并发给《统计检查员证书》。《统计检查员证书》由国家统计局统一印制。统计检查员在执行任务时，有权发出《统计检查查询书》。被检查单位的领导人及有关人员应当负责按期据实答复；拒绝答复的，以拒报论处。 第二十五条 企业事业组织的统计机构或者统计负责人执行本单位综合统计的职能，其职责是：一、组织指导、综合协调本单位各职能机构和下属机构的统计工作，并共同完成国家统计调查、部门统计调查和地方统计调查任务，制定、实施本单位的统计工作计划和统计制度，贯彻并检查监督统计法规的实施；二、按照规定，向主管部门和所在地人民政府统计机构、乡镇统计员报送和提供统计资料，对本单位计划的执行情况、经营管理的效益，进行统计分析和统计监督；三、管理本单位的统计调查表和基本统计资料；四、会同有关职能机构完善计量、检测制度，健全原始记录、统计台账和核算制度。企业事业组织的统计机构或者统计负责人在统计业务上受所在地人民政府统计机构或者乡镇统计员的指导。中小型企业事业组织不单设统计人员的，可以指定有关人员专门负责统计工作。 第二十六条 统计负责人，是指代表本部门或者本单位履行《统计法》规定职责的行政人员。不设统计机构的，一般应由具备相当统计专业职务条件的人员担任统计负责人。 第二十七条 各地方、各部门、各企业事业组织，应当根据国家规定和工作需要设置统计专业职务。 第二十八条 具有统计专业职务的人员的调动，应当分别征求本地区、本部门、本单位统计机构或者统计负责人的意见。对其中具有中级以上专业职务的人员的调动应当征得上级统计机构同意。地方各级人民政府统计机构主要负责人的调动，应当征得上一级人民政府统计机构的同意。乡镇统计员的调动应当征得县人民政府统计机构的同意。各主管部门和企业事业组织统计负责人的调动，应征求上级主管部门和当地人民政府统计机构的意见。 第二十九条 各级统计机构新增加和补充的统计人员一般应当在大学本科、专科和中专毕业生中选调；如需从高中毕业生中招收，应当经过考试，择优录用。现有专业统计人员不具备统计专业知识的，由主管的统计机构组织培训，进行考试或者考核，并将结果报人事部门；对不合格者应当降职使用或者调离专业统计岗位。统计人员调动工作或者离职，应当有能够担当规定职责的人员接管，并须办清交接手续。 第五章 奖励与惩罚 第三十条 各级人民政府统计机构、各主管部门、各企业事业组织，应当依照国家或者企业事业组织的规定，对有下列表现之一的统计人员或者集体，定期评比，给予奖励：一、在改革和完善统计制度、统计方法等方面，有重要贡献的；二、在完成规定的统计调查任务，保障统计资料的准确性、及时性方面，做出显著成绩的；三、在进行统计分析、统计预测和统计监督方面有所创新，取得重要成绩的；四、在运用和推广现代信息技术方面，有显著效果的；五、在改进统计教育和统计专业培训，进行统计科学研究，提高统计科学水平方面，做出重要贡献的；六、坚持实事求是，依法办事，同违反统计法规的行为作不懈斗争，表现突出的。奖励分为：通令嘉奖、记功、记大功、晋级、升职、授予荣>称号，并可以发给奖品、奖金。奖金按国家或者企业事业组织规定在有关经费中开支。 第三十一条 凡有下列行为之一、情节较重但尚未构成犯罪的，应当分别情况由主管机关对有关领导人或者直接人员，给予行政处分：一、虚报、瞒报统计资料的；二、伪造、篡改统计资料的；三、拒报或者屡次迟报统计资料的；四、侵犯统计机构、统计人员行使《统计法》及本实施细则规定的职权的；五、违反《统计法》规定，未经批准，自行编制发布统计调查表的；六、违反《统计法》规定，未经核定和批准，自行公布统计资料的；七、违反《统计法》有关保密规定的。行政处分分为：警告、记过、记大过、降级、降职、撤职、留用察看、开除。个体经营户有上列一、二、三项违法行为之一、情节严重的，经县级以上人民政府批准，由工商行政管理部门给予暂停营业或者吊销营业执照的处罚。 第三十二条 当事人对违反本实施细则第三十一条所受行政处分不服的，可向上级机关提出申诉。 第三十三条 对违反《统计法》构成犯罪的人员，由司法机关依法追究刑事。 第六章 附 则 第三十四条 本实施细则由国家统计局负责解释。 第三十五条 本实施细则自发布之日起施行。 RULES FOR THE IMPLEMENTATION OF THE STATISTICS LAW OF THE It mainly includes:statistics of population and labour force; statistics of national wealth;statistics of farming; forestry, animal husbandry, fishery and waterconservancy; statistics of industry; statistics of building industry;statistics of communications and transportation and post andtelecommunications; statistics of commerce, catering trade, supply andmarketing of materials and storage; statistics of real estateadministration, public utilities, neighborhood services and consultationservices; statistics of public health, physical culture and socialwelfare; statistics of education, culture and arts, broadcast, films andtelevision; statistics of scientific studies and comprehensive technicalservices; statistics of banking and insurance; statistics of finance andfinancial affairs; statistics of prices; statistics of comprehensivebalance of national economy; statistics of fixed assets investment;statistics of people's life; statistics of politics, law and civiladministration, etc..Article 3Statistical data must be provided in accordance with the provisions of theStatistics Law and these Rules by all the state organs, socialorganizations, enterprises and institutions, various self-employedbusiness operators and all types of economic partnerships in urban andrural areas; enterprises and institutions with exclusive foreign capital,or in form of Chinese foreign equity joint ventures or contractual jointventures established in China; enterprises and institutions solely owned,jointly owned or cooperatively operated by the compatriots from Hong Kong,Macao and Taiwan and overseas Chinese in China; as well as enterprises andinstitutions solely owned, jointly owned or cooperatively operated byChina in Hong Kong, Macao and in foreign countries. They may not makefalse and deceptive reports, or refuse to make reports, or delay thereports. No forgery or illegal alterations of reports shall be lf-governing mass organizations at the grass-roots level and citizensshall have the obligation to provide accurate information needed in statestatistical ticle 4The state shall, in a planned way, equip statistical agencies under thepeople's governments at various levels with modern information technologyand set up and perfect the state automatic system for statisticalinformation. The various competent departments in the State Council may,according to their needs, equip in a planned way the statistical agenciesat the departments and their affiliated organizations with moderninformation ticle 5Statistical agencies at various levels and statistical personnel mustestablish responsibility systems as well as systems for checks, awards andpenalties for their staff so as to improve their work and raise efficiencyconstantly. At the same time, they shall exercise the following functionsand powers independently according to law:(1) the power of statistical survey - investigating and collectingrelevant information, holding relevant investigation meetings, checkingall kinds of original records and evidence concerning statistical e units and personnel to be investigated must provide true informationand data and may not refuse to make reports, or make false or deceptivereports;(2) the power to make statistical reports - sorting out and analysing theinformation and data obtained from statistical investigations andsubmitting statistical reports to leading organs at higher levels andrelevant departments. No units and individuals shall obstruct or withholdthe statistical reports nor tamper with statistical data;(3) the power of statistical supervision - according to statisticalinvestigation and statistical analysis, conducting statistical supervisionof the national economic and social development, checking theimplementation of national policies and plans, assessing economic results,social effect and achievements, examining and exposing existing problems,examining practices of making false and deceptive statistical reports andsubmitting proposals for the improvement of work. Departments concernedshall promptly deal with and reply to the problems reported or exposed andthe proposals made by statistical agencies and ticle 6Local people's governments, at various levels, competent departments andenterprises and institutions shall, according to the state statisticaltasks and the needs of their respective localities, departments and units,strengthen the leadership and supervision over statistical work:(1) leading and supporting statistical agencies and personnel and otherrelevant personnel in implementing statistical laws, regulations andsystems, completing accurately and timely statistical tasks and promotingmodernization of statistical work;(2) drawing and organizing statistical personnel into meetings to discussrelevant policies and plans and study questions concerning economic andsocial development so that statistics may play a role of service andsupervision;(3) organizing implementation of major general investigations of nationalconditions and national strength according to the State's unified plan;(4) examining and approving plans of statistical investigation accordingto relevant provisions and providing the personnel and funds needed forthe approved statistical ticle 7The State Statistical Bureau and statistical agencies under the localpeople's governments at or above the county level shall be the stateorgans to execute statistical laws and regulations and supervise theirimplementation. It shall be their responsibility to check theimplementation of statistical laws and regulations, uphold the lawfulpowers and rights of statistical agencies and personnel and fight againstviolations of statistical laws and regulations. Chapter II Statistical Investigation Plans and Statistical SystemsArticle 8Statistical agencies and competent departments under the people'sgovernments at or above the county level shall establish separatestatistical systems and draw up separate statistical investigation plansat the following three levels and shall implement the systems and plansafter they have been approved by examination organs according to relevantprovisions:(1) National statistical investigation. It shall be a nation-widestatistical investigation of the basic conditions in the country, coveringsuch items for investigation as solely worked out by the State StatisticalBureau and those jointly worked out by the State Statistical Bureau andrelevant departments under the State Council. New and important items forinvestigation in national statistical investigation plans shall bereported to the State Council for examination and approval by the StateStatistical Bureau. Regular and general items for investigation shall beexamined and approved by the State Statistical Bureau as authorized by theState Council. All localities, departments and units must strictlyimplement national statistical investigation e State generally carries out a major general investigation of nationalconditions and national strength (population, industries, agriculture,building industry, service trades, etc.) every ten years. A simplifiedinvestigation of population shall be conducted between two major generalinvestigations.(2) Departmental statistical investigation. It shall be a specializedstatistical investigation conducted by various departments. The plans andprograms of departmental statistical investigation shall be worked out byvarious specialized institutions concerned under statistical agencies inthe pertinent departments. If the objects of investigation are withintheir own systems of jurisdiction, the plans and programs shall beexamined and approved by the leaders of these departments and reported tothe State Statistical Bureau or the statistical agencies in the localpeople's governments at the same level for the record. If the objects ofinvestigation are outside the departmental system of jurisdiction, theplans and programs shall be reported to the State Statistical Bureau orthe statistical agencies in the local people's governments at the samelevel for examination and approval. Important plans and programs shall bereported to the State Council or the local people's governments at thesame level for examination and approval. The division of jurisdiction forstatistical investigation among various departments shall be worked out bythe State Statistical Bureau in consultation with the competentdepartments under the State Council and reported to the State Council forapproval and implementation.(3) Local statistical investigation. It shall be the statisticalinvestigation needed by local people's governments. The procedures forreporting and approval of local statistical investigation plans andprograms shall be stipulated by the statistical bureaux under the people'sgovernments of the provinces, autonomous regions and municipalitiesdirectly under the Central Government and reported to the StateStatistical Bureau for the ticle 9Departmental and local statistical investigations may not overlap orcontradict national statistical e division of work among national statistical investigation,departmental statistical investigation and local statistical investigationshall be decided by the State Statistical Bureau after consultation withthe competent departments under the State Council and the statisticalbureaux under the people's governments of the provinces, autonomousregions and municipalities directly under the Central ticle 10The statistical data needed by the departments for comprehensivecoordination under the people's governments at various levels shallgenerally be obtained from the statistical agencies and the relevantcompetent departments under the people's governments at the same en necessity arises for direct statistical investigation, plans andprograms shall be worked out and implemented after being examined andapproved in accordance with the provisions of the Statistical Law andthese ticle 11Statistical investigation plans shall be worked out on the basis ofprojects of statistical investigation. A project of statisticalinvestigation refers to a statistical investigation organized in aspecified time period for a certain investigation objective. The plan ofeach investigation project shall specify the following: name of project,organ to conduct the investigation, objective, scope, object(s), manner,duration, and main content of investigation. Investigation programs ofstatistical investigation projects shall be worked out simultaneously withthe statistical investigation plan. An investigation program shallinclude:(1) investigation forms to be filled out by objects of investigation andwritten directions;(2) overall statistical forms to be filled out and reported to theleadership and written directions;(3) the personnel and funds needed for statistical investigations and thesources ticle 12The statistical agencies under the people's governments at various levelsand those in the various competent departments shall strictly examine thestatistical investigation plans and their investigation programs sent infor examination as to their necessity, feasibility and scientificreliability. Those which do not conform to the provisions of these Rulesshall be returned for alterations or rejected. In drafting and examiningstatistical investigation programs, the following principles shall beadhered to:(1) if the relevant data can be obtained from the statisticalinvestigations which have been approved or conducted, no suchinvestigations shall be repeated;(2) comprehensive statistical investigation forms shall not be printed andissued if the objectives can be achieved through sample, key and typicalcase investigations or administrative registration. Regular statisticsshall not be conducted if a single investigation can satisfy the needs. Ifyearly statistics suffices the needs, no quarterly statistics shall beconducted; quarterly one suffices, no monthly one shall be done. Progressstatistics more frequent than monthly one must be strictly restrained;(3) before a new statistical investigation program is made public, testsshall be conducted at selected places, or the opinions of the relevantlocalities, departments and grassroots units be heard, and feasibilitystudy be made, so as to ensure that the program is practicable and thebest possible investigation result receives due attention;(4) the personnel and funds needed for the statistical investigationsshall be ticle 13For a statistical investigation program that has been approved accordingto the prescribed procedures, the designation of the organ which hasdevised the investigation form, serial number of the form, the designationof the organ to which the program has been sent for approval or for therecord and the serial number of approval shall all be indicated in theupper right-hand corner of the investigation form. The units andindividuals to be investigated shall fill out the forms accurately,promptly and atistical investigation forms (including investigation outlines withcollecting statistical data as the main objective without the above-mentioned indicators shall be illegal forms, which all units andindividuals have the right to refuse to fill out and which the statisticalagencies under the people's governments at various levels are empowered ticle 14Without consent of the organ which has drawn up the statisticalinvestigation program, no unit or individual shall revise the indeximplications, scope of investigation, methods of calculation, classifiedtable of contents, format of the form, statistical codes, etc. asprescribed in the statistical investigation program. Chapter III Administration and Announcement of Statistical DataArticle 15All localities, departments and units shall amplify the system ofexamination and verification of statistical data and guarantee theaccuracy and promptness of statistical e statistical data provided by various departments, enterprises andinstitutions shall be examined, verified, signed or sealed by the leadersof the respective departments and units or the persons responsible forstatistics before they are sent to the higher leadership. Data concerningfinancial statistics shall be provided by financial organs or financialpersonnel and shall be examined, verified and sealed by persons in chargeof financial departments. The statistical data provided by the statisticalagencies under the people's governments at various levels and by thestatisticians in townships and towns shall be examined, verified, signedor sealed by the leading personnel in the statistical agencies under thepeople's governments or by statisticians in townships and towns beforethey are sent to the higher aders of various localities, departments and units shall not makealterations in the statistical data provided by statistical agencies andpersonnel according to the Statistics Law or statistical system. If theyconsider the relevant data untrue, they shall order the statisticalagencies and personnel and other relevant personnel to verify and correctthem. If the deadline for data reporting has come, the data may bereported first with due notations. If mistakes are really found afterverification, corrections shall be made without the time limit set by ticle 16If statistical data are needed in formulating policies and plans, checkingthe implementation of policies and plans, assessing economic and socialresults and performance, and meting out awards and penalties, etc.,leading organs at various levels shall, in accordance with the provisionsin Article 12 of the Statistics Law, take as solely credible thestatistical data bearing the signatures or seals of the statisticalagencies or persons in charge of ticle 17The statistical agencies under the people's governments at various levelsmust provide good consultancy services in statistical information andserve the community by making full use of all social and economicinformation that can be made known to the public. Consultancy services instatistical information not controlled by the Statistics Law andstatistical systems but provided in conformity with the relevantprovisions of the State shall be non-gratuitous. The measures for suchnon-gratuitous services shall be formulated by the State StatisticalBureau in conjunction with the State Administration for Commodity ticle 18All localities, departments and units must implement the MeasuresConcerning Security and Administration of Statistical Data formulated bythe State Statistical Bureau so as to strengthen unified administration ofstatistical ticle 19All localities, departments and units must establish systems ofstatistical data files and these files shall be properly kept, transferredand turned over in accordance with the relevant provisions of the StateArchives Bureau. Chapter IV Statistical Agencies and Statistical PersonnelArticle 20The function and responsibilities of the State Statistical Bureau shall beas follows:(1) formulating regulations concerning statistical work, drafting programsto update statistical work, drawing up State statistical investigationplans, leading and coordinating national statistical work and checking andsupervising the implementation of statistical laws and regulationsaccording to the State laws, policies and plans;(2) amplifying accounting systems of national economy and systems ofstatistical indexes, formulating the system of nationally unified formsfor basic data reporting, formulating solely or jointly with relevantdepartments national statistical standards and examining and approvingdepartmental statistical standards;(3) under the unified leadership of the State Council, organizing jointlywith relevant departments major general investigations of the nationalconditions and national strength, organizing and coordinating sampleinvestigations of social and economic conditions in urban and rural areasthroughout the country;(4) in accordance with the needs of the State in deciding policies,formulating plans and carrying out administration, collecting, sorting outand providing basic statistical data of the nation and conductingstatistical analysis, forecast and supervision of the national economicand social development;(5) examining the statistical investigation plans and their investigationprograms of the various departments under the State Council and exercisingcontrol over the investigation forms issued by the various departmentsunder the State Council;(6) checking, examining and approving, controlling, announcing andpublishing nationwide basic statistical data and regularly issuingstatistical bulletins concerning the national economic and socialdevelopment;(7) leading and controlling the groups responsible for sampleinvestigations of the social and economic conditions in the urban andrural areas throughout the country;(8) organizing and directing nationwide statistical scientific studies,statistical education, the training of statistical personnel and thepublication of statistical books and periodicals;(9) conducting international exchanges in statistical work and ticle 21The functions and responsibilities of the statistical agencies under thelocal people's governments at or above the county level (includingmunicipal districts) shall be:(1) accomplishing tasks of national statistical investigations, applyingnational statistical standards and implementing the system of nationallyunified forms for basic statistical reporting;(2) drafting plans to update local statistical work, working outstatistical investigation plans and the investigation programs, leadingand coordinating the statistical work conducted by the central and localunits in the localities and checking and supervising the implementation ofstatistics laws and regulations;(3) collecting, sorting out, and providing basic statistical data andconducting statistical analysis, forecast and supervision of the essentialconditions of the economic and social development in their respectivelocalities in accordance with the needs of these localities in policyformulation, plan drafting and administration;(4) examining the statistical investigation plans and investigationprograms of the various departments in their respective localities andexercising control over the investigation forms devised and issued by thevarious departments in these localities;(5) checking, examining and approving, controlling, announcing andpublishing the basic statistical data of their own localities according torelevant stipulations. The statistical bureaux under the people'sgovernments in the provinces, autonomous regions and municipalitiesdirectly under the Central Government shall regularly publish statisticalbulletins pertaining to the national economic and social development intheir respective localities. The statistical agencies under the people'sgovernments of municipalities and counties shall publish statisticalbulletins according to the decisions of the people's governments at thesame level;(6) exercising unified control over the groups responsible for sampleinvestigations of the social and economic conditions in the urban andrural areas in the localities;(7) organizing and directing all the departments and units in thelocalities in strengthening their foundational statistical work,intensifying statistical education, the training of statistical cadres andstatistical scientific studies, assessing the performance of the cadres ofthe statistical agencies under the governments and the statisticians inthe townships and towns in their respective localities and meting outawards and e statistical agencies under the local people's governments at variouslevels shall be under the dual leadership of the people's governments atthe same levels as well as the statistical agencies under the people'sgovernments at the next higher levels; in terms of statistical work, theyshall be subject mainly to the leadership of the statistical agenciesunder the people's governments at the next higher ticle 22The statisticians in townships and towns shall be responsible for localcomprehensive statistics. Their responsibilities are:(1) accomplishing tasks of national and local statistical investigation,applying national statistical standards, implementing the system ofnationally unified forms for basic statistical reporting, and checking andsupervising the implementation of statistical laws and regulations;(2) collecting, sorting out, analysing, providing and administering thestatistical data of the townships and towns in accordance with relevantstipulations;(3) organizing and directing relevant departments and individuals of thetownships and towns in strengthening rural foundational statistical work,amplifying systems of statistical accounting and statistical files in thetownships and towns and leading the statistical work in places under e people's governments in the provinces, autonomous regions andmunicipalities directly under the Central Government or in themunicipalities and counties shall post statisticians in townships andtowns in accordance with the provisions of the Statistics Law and theneeds of statistical work and shall set up and improve networks ofstatistical information among townships and towns. Vocationally,statisticians in townships and towns and the statistical networks shall beunder the leadership of the statistical agencies under the people'sgovernments at the county e statistical work in the administrative hamlets under townships andtowns shall be administered by the persons specially appointed byvillagers and committees. Vocationally, they shall be under theleadership of townships and towns ticle 23The statistical agencies or the persons responsible for statistical workin the competent departments under the people's governments at variouslevels shall perform the comprehensive statistical functions in theirdepartments. Their functions and responsibilities shall be:(1) organizing, directing and, in a comprehensive way, coordinating thestatistical work of various functional organs in the departments (such asorgans of production, supply and marketing, capital construction, labourand personnel, finance, and accounting, etc.), jointly accomplishing thetasks of national, departmental and local statistical investigation andimplementing, checking and supervising the implementation of statisticallaws and regulations;(2) drafting plans to update the statistical work in the departments,working out the statistical investigation plans and their investigationprograms of the departments, organizing and directing the statistical workof enterprises and institutions in the departments or in the systems undertheir jurisdiction, and intensifying the building of statisticalcontingents and of the foundation of statistical work;(3) in accordance with relevant stipulations, reporting and providing thebasic statistical data of the departments to leading organs and thestatistical agencies under the people's governments at the same levels andconducting, in conjunction with planning and other relevant functionalorgans, statistical analysis, forecast and supervision of theimplementation of the policies and plans and the results of management andadministration in these departments;(4) administering the statistical investigation forms devised and issuedby the basic statistical data of the departments they belong to;(5) organizing and directing, in conjunction with the personnel andeducational agencies in the departments they belong to, the statisticaleducation and the training of statistical cadres, assessing theperformances of the statistical personnel and meting out awards andpenalties, and strengthening the study of statistical science in thesedepartments. The statistical agencies of the competent departments in thepeople's governments at various levels shall be established according toactual needs and the principle of efficient and simple administration andin the light of the provisions of the Statistics ticle 24The statistical agencies and the various competent departments under thepeople's governments at various levels may, in accordance with the needsof their tasks, set up statistical inspection agencies or posts forstatistical inspectors provided that no excess staff shall occur. Theresponsibilities of statistical inspection agencies and statisticalinspectors are:(1) checking regularly and thoroughly the implementation of statisticallaws and regulations and exposing, informing against or dealing withviolations of statistical laws and regulations;(2) meting out penalties for the individuals and units that violatestatistical laws and regulations; if crimes are committed, the relevantindividuals or units shall be investigated for criminal liability byjudicial organs;(3) submitting proposals concerning commendation and awards for thoseindividuals or collectives that meet the requirements of Article 30 ofthese Rules. Statistical inspection agencies and statistical inspectorsshall exercise the authority of statistical inspection within theprescribed limits of responsibility. Statistical inspectors shall beappointed by the statistical agencies under the people's governments atvarious levels or the various competent departments and be issued withStatistical Inspector's Certificate, which shall be printed by the StateStatistical Bureau. When performing their duties, statistical inspectorsshall be empowered to send out Inquiries for Statistical Inspection, whichshall be answered accurately and promptly by the leaders and the personsin charge in the inspected units. Those who refuse to answer shall bepunished according to relevant ticle 25The statistical agencies or persons in charge of statistics in enterprisesand institutions shall take charge of the comprehensive statistics intheir units. Their functions and responsibilities shall be:(1) organizing, directing and coordinating in a comprehensive way thestatistical work of the various functional organs and subordinate agenciesin their units, jointly accomplishing the tasks of national, departmentaland local statistical investigation, formulating and implementing thestatistical plans and systems of their units, implementing, checking andsupervising the implementation of statistical laws and regulations;(2) in accordance with relevant stipulations, reporting and providingstatistical data to the competent departments, the statistical agenciesunder the local people's governments and statisticians in townships andtowns and conducting statistical analysis and supervision of theimplementation of the plans and the results of management andadministration in their units;(3) administering the statistical investigation forms and basicstatistical data of their units;(4) in conjunction with relevant functional organs, improving systems ofmeasurement and testing, amplifying systems of original records,statistical accounting and bookkeeping. The statistical agencies orpersons in charge of statistics in enterprises and institutions shall bedirected by the statistical agencies under the local people's governmentsor townships and towns statisticians in statistical matters. In small andmedium-sized enterprises and institutions where there are no full-timestatisticians, persons may be appointed to be specially responsible forstatistical ticle 26The term of persons in charge of statistics refers to personnelundertaking administrative duties who perform the responsibilitiesprovided for in the Statistics Law on behalf of their departments orunits. In general, where there are no statistical agencies, personsqualified to take up professional statistical posts shall be put in chargeof ticle 27All localities, departments and enterprises and institutions shallestablish professional statistical posts according to state stipulationsand actual ticle 28Before any persons holding professional statistical posts are transferred,it shall be necessary to seek the opinions of the statistical agencies orpersons in charge of statistics in their respective localities,departments and units. Consent shall be obtained of the statisticalagencies at the next higher levels prior to the transfer of any personsholding professional posts above intermediate levels. Consent of thestatistical agencies under the people's governments at the next higherlevels shall be obtained prior to the transfer of the chief responsiblecadres in the statistical agencies under the local people's governments atvarious levels. Consent shall be obtained of the statistical agenciesunder the people's governments at county level prior to the transfer oftownships and towns statisticians. Consent of the competent departmentsat the next higher levels and the statistical agencies under the localpeople's governments shall be obtained prior to the transfer of chiefresponsible persons of statistics in the various competent departments andenterprises and ticle 29The statistical agencies at various levels shall generally recruitstatistical personnel from among graduates of colleges, junior collegesand technical secondary schools. If it is necessary to recruit from amongsenior middle school leavers, the candidates must go through examinationsand only those who have done well shall be taken. The statistical agenciesin charge shall organize training and examination or assessment of thoseexisting statistical personnel who have not received formal training instatistics and shall report the results to the personnel ose who are not qualified shall be demoted or removed from professionalstatistical en statistical personnel are transferred or removed from office, personscompetent for the prescribed responsibilities shall take over and gothrough relevant procedures for it. Chapter V Awards and PenaltiesArticle 30The statistical agencies under the people's governments at various levels,various competent departments and enterprises and institutions shall, inaccordance with the stipulations of the State or the enterprises andinstitutions, make regular assessment and give awards to the statisticalpersonnel or groups of people that fall into any of the followingcategories:(1) those who have made important contributions to reforming and improvingstatistical systems and methods;(2) those who have made remarkable achievements in accomplishingprescribed tasks of statistical investigation and ensuring the accuracyand promptness of statistical data;(3) those who have brought forth new ideas and made important achievementsin statistical analysis, forecast and supervision;(4) those who have achieved remarkable results in the application anddissemination of modern information technology;(5) those who have made important contributions to improving statisticaleducation and statistical professional training, conducting scientificresearch in statistics and raising the levels of statistical science;(6) those who have outstanding performances in upholding a practical andrealistic style of work, acting within the framework of law and wagingunremitting struggles against violations of statistical laws e awards may be rated as follows: issuance of commendatory order, amerit for the record, a special merit for the record, promotion in titleor rank, conferment of an honorary title. Prizes and bonuses may also beawarded. The bonus shall be paid from the relevant funds according to theprovisions of the State or enterprises and ticle 31For any of the following acts, which is not grave enough to constitute acrime, the departments in charge shall, in the light of specificsituations, subject the relevant leaders or persons directly responsibleto administrative sanctions:(1) making false and deceptive reports pertaining to statistical data;(2) forging or tampering with statistical data;(3) refusing to make reports or repeatedly delaying reports on statisticaldata;(4) preventing statistical agencies or personnel from exercising theirfunctions provided for in the Statistics Law and these Rules;(5) making and issuing statistical investigation forms without approval,in violation of the relevant provisions in the Statistics Law;(6) making statistical data public without approval before they arechecked and approved, in violation of the relevant provisions in theStatistics Law;(7) violating the relevant security provisions in the Statistics ministrative sanctions may be classified as follows:warning, a demerit for the record, a special demerit for the record,demotion in title or rank, removal from office, probation on job serious cases where private businesses that have committed any of thefirst three illegal acts mentioned above shall, upon approval of thepeople's governments at or above the country level, be subject to apenalty of suspension of business or revocation of business licence byadministrative departments for industry and ticle 32If a party concerned refuses to accept the administrative sanction imposedfor violating Article 31 of these Rules, it (he) may appeal to the ticle 33Those who have committed crimes in violating the Statistics Law shall beinvestigated for criminal responsibility according to law by judicialorgans. Chapter VI Supplementary ProvisionsArticle 34The State Statistical Bureau shall be responsible for the interpretationof these ticle 35These Rules shall go into effect as of the date of promulgation.
